SAVED NATURE PHOTOGRAPHY COMPETITION TERMS AND CONDITIONS OF ENTRY

1.          COMPETITION DETAILS 
 
COMPETITION    2014 IUCN World Parks Congress SAVED Nature Photography Competition

ENTRY PERIOD Open date:  May 28, 2014 at 00:01 Australian Eastern Standard Time (“AEST”)                 
Closing date:  October 15, 2014, 23:59 AEST
COMPETION CATEGORIES
 
Each entry must feature a protected area of the world and fall within one of the following theme categories:
Parks: This category relates to landscapes and seascapes from Protected Areas anywhere in the world.
People: This category relates to people respecting and enjoying Protected Areas anywhere in the world, including Indigenous peoples’ conserved areas and territories.
Planet: This category relates to conservation of Protected Areas anywhere in the world that involves active intervention to meet the needs of particular species or habitats.
ENTRY RESTRICTIONS The Competition may be entered by amateur or professional photographers aged 13 years and over.
Entrants in the Youth prize must be aged between 13 and 18 years at the close of the Competition (15 October 2014)
Employees and contractors of the Promoter, and of any agencies, retailers and suppliers connected with the Competition or the 2014 World Parks Congress, and the immediate family members of these people are ineligible to enter. “Immediate family members” means spouse, parent, child (whether adopted or natural) or sibling (whether natural or adopted by a parent) whether or not they live in the same household as the employee or contractor.
COMPETITION DIVISIONS Specialist Division - AUD $15,000 cash prize – AUD $25 registration fee per entry via Website
Enthusiast Division-  AUD $3,000 cash prize – free entry via Website
Social Division – AUD $3,000 cash prize - free entry via Instagram
Youth Prize -  AUD $3,000 cash prize – free entry for ages 13 to 18 years only – entered by selecting age range on registration and entering via either free method (Enthusiast or Social divisions).

2.          CONDITIONS OF ENTRY
 
2.1.     To enter the Competition an entrant must comply with the Entry Requirements within the Entry Period and comply with all other Conditions of Entry.
2.2.     Entry into the Competition constitutes acceptance of these terms and conditions
2.3.     These terms and conditions, along with all Instructions and information on how to enter the Competition, form the Conditions of Entry.
2.4.     Capitalised terms in these terms and conditions have the meaning set out in condition 1 unless otherwise provided.
 
3.           ENTRY REQUIREMENTS
 
3.1.      The entrant must submit a photograph and an accompanying story (collectively, the entry).
3.2.       All entries received will be made public. It is a condition of entry that you give permission to publish your entry, inclusive of your photograph, story and name.
3.3.      The entry must feature a Protected Area of the World.
3.4.      A Protected Area is a clearly defined geographical space, recognised, dedicated and managed through legal or other effective means, to achieve the long-term conservation of nature with associated ecosystem services and cultural values. Protected areas may be either land or marine. More information about Protected Areas is available via these sites:

3.5.      Each entry must fall within one of the three Theme Categories set out in condition 1.

4.          COMPETITION PROCEDURE
 
To enter the competition, an entrant must, during the Entry Period:
 
4.1.     Go to the Website and register their details, completing all required fields and accepting the terms and conditions of entry.
4.2.     Submit one photograph that complies with the Photograph Requirements in accordance with the procedure for one of the Divisions, as set out below.
4.3.     Submit a story or description that complies with the Story Requirements.
4.4.     Additional requirements per division:

Specialist Division

4.4.1   Entries into the Specialist Division must be submitted  via the Website
4.4.2   The entrant must pay a AUD $25 registration fee per image on entry.

Enthusiast Division
4.4.3   Entries into the Enthusiast Division must be submitted via the Website.
4.4.4   There is no registration fee.
4.4.5   Entries in this division are limited to a maximum of five (5) entries per person.

Social Division       
4.4.6   Entries into the Social Division must be submitted via Instagram using one of the hashtags #wpcparks, #wpcpeople or #wpcplanet and the email address and Instagram handle the entrant has registered on the Website.
4.4.7   Registration via the Website with the inclusion of the Instagram handle is required prior to loading and tagging images on Instagram in order for the match to be identified. 
4.4.8   There is no registration fee.

Youth Division
4.4.9 Entries into the Youth Division must be submitted via the Website or Instagram by using the same procedures and Photograph 4.4.10 Requirements as specified for the Enthusiast Division (Website) or Social Division (Instagram) and selecting the entrant’s age range when registering.
4.4.11 There is no registration fee.

5.          PHOTOGRAPH REQUIREMENTS 
 
5.1.     Photographs must have been taken within two (2) years before the date of entry.
5.2.     The photograph, in its entirety, must be a single work of original material taken by the entrant.
5.3.     The photograph must not, in the sole and unfettered discretion of the Promoter, contain obscene, provocative, defamatory, sexually explicit, unlawful or otherwise objectionable or inappropriate content.
5.4.     Additional requirements specific to Division:


Specialist Division
5.4.1   Photographs must be submitted in digital format, however the photograph need not be taken with a digital camera. Electronic scans of negatives, transparencies or photographic prints are eligible.
5.4.2   All digital files must be a maximum of 10 megabytes, must be in JPEG or .jpg format, and must be a maximum of 5,500 pixels wide x 5,500 pixels high.
5.4.3   Only minor burning, dodging and/or colour correction is acceptable, as is cropping. Stitched panoramas are acceptable. High dynamic range images (HDR) are not eligible. Any photograph that has been subjected to any other changes not itemised here is not eligible.

Enthusiast Division
5.4.4   Photographs must be submitted in digital format, however the photograph need not be taken with a digital camera. Electronic scans of negatives, transparencies or photographic prints are eligible
5.4.5   All digital files must be a maximum of 10 megabytes, must be in JPEG or .jpg format, and must be a maximum of 5,500 pixels wide x 5,500 pixels high.

Social Division
5.4.6   Photographs must comply with Instagram requirements.
 
6.          STORY REQUIREMENTS
 
6.1.     The story must be a short description of how the engagement of individuals, communities, governments, businesses or other entities has positively contributed to enjoyment and conservation of the Protected Area.
6.2.     The story must not be more than a maximum 150 words. 

7.          LICENCE
 
By entering the Competition, the entrant:
7.1.     grants an irrevocable, perpetual, worldwide non-exclusive license to the Promoter to reproduce, distribute, display and create derivative works of the entry (along with a name credit) in connection with the Competition and promotion of the Competition, in any media now or hereafter known, including, but not limited to: display at an exhibition of winners; publication in a book featuring entries in the Competition; publication in NSW National Parks and Wildlife Naturescape magazine; publication on the NSW National Parks and Wildlife website; and publication on the IUCN World Parks Congress website;
7.2.     subject to the requirement in condition 7.1 to include a name credit with all uses of the entry, consents to the Promoter doing or omitting to do any act that would otherwise infringe the entrant’s “moral rights” in their photograph and story;
7.3.     grants the Promoter an unrestricted right to use all statements made in connection with the Competition, and pictures or likenesses of the entrant, in any reasonable manner, and to permit third parties to do so, at the Promoter’s sole discretion; and
7.4.     acknowledges that the Promoter will not be required to pay any additional consideration or seek any additional approval in connection with use described in this clause 7 (except where prohibited by law).

8.          ENTRANT WARRANTIES , INDEMNITIES and RELEASES
 
8.1.     By entering the Competition the entrant represents, acknowledges and warrants that the submitted photograph and story are original works created solely by the entrant, that the photograph and story do not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph or story.
8.2.     If the photograph contains any material or elements that are not owned by the entrant, and/or are subject to the rights of third parties, and/or any persons appear in the photograph, the entrant must obtain, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these terms and conditions without additional compensation.
8.3.     By entering this Competition, all entrants agree to release, discharge, and hold harmless the Promoter and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Competition or any Competition-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
8.4.     Entrants release Facebook and Instagram and their associated companies from all liability in respect of the Competition and acknowledge that the Competition is in no way sponsored, endorsed or administered by or associated with Facebook or Instagram.
8.5.     The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof including any error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise preventing entrants form successfully submitting an entry, any injury or damage to entries or to participants or any other persons computer related to or resulting from participation in or downloading any materials in this Competition. 

9.          LIMITATION OF LIABILITY
 
9.1.     The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorised access to Competition entries or entry forms; or alteration of entries or entry forms.
9.2.     The Promoter is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Competition
9.3.     The preceding two clauses do not operate in respect of any implied condition or warranty the exclusion of which from these terms and conditions would contravene any Australian statute or cause any part of these terms and conditions to be void.

10.       JUDGING 
 
10.1.  The entries will be judged in accordance with this clause 10.
10.2.  The Promoter will appoint professional photographers as independent Judges.
10.3.  The Judges’ decisions are final, and no correspondence regarding those decisions will be entered into.

Judging process & criteria – Specialist Division
 
10.4.  Judging will consists of two (2) rounds of evaluation.
10.5.  In Round One, each entry will be reviewed by at least one Judge. The Judge(s) will evaluate the entry according to the Judging Criteria and determine whether the entry is appropriate to proceed to Round Two.
10.6.  At the completion of Round One, entries will be shortlisted as finalists and proceed to Round Two.
10.7.  Round Two finalist entries will be evaluated by a panel of Judges who will evaluate the entry according to the Judging Criteria and collectively select a winner. 
10.8.  The Judging Criteria for the Specialist Division are:
  1. Compelling Content/Story 50%;
  2. Photographic quality 50%.
10.9.  In the event of a tie, the tied entries will be re-submitted to the Judges for a re-judging and the winner will be decided by a majority decision of the panel.

Judging process & Criteria - Enthusiast and Youth Divisions 
 
10.10.   Judging will consist of two (2) rounds of evaluation. 
10.11.   Round One will shortlist the 100 most popular entries for each Division. The most popular entries will be determined by assessing the number of times the entry is “Shared” on Facebook (either from Instagram to Facebook or within Facebook) during the Entry Period ;
10.12.   At the completion of Round One the 100 most popular entries will be shortlisted as finalists and proceed to Round Two.
10.13.    Round Two finalist entries will be evaluated by a panel of Judges who will evaluate the entry according to the Judging Criteria and collectively select a winner for each Division. 
10.14.   The Judging Criteria for Round Two in the Enthusiast Division and Youth Divisions are:
  1. Compelling Content/Story (50% weighting);
  2. Photographic quality (50% weighting).
10.15.   In the event of a tie, the tied entries will be re-submitted to the Judges for a re-judging and the winner will be decided by a majority decision of the panel.
10.16.   A Youth entrant is only eligible to win one prize.  The winners of the Youth and the Enthusiast divisions must not be the same entrant.

Judging process & Criteria – Social Division
 
10.17.   Judging will consist of two (2) rounds of evaluation.
10.18.   Round One will shortlist the 50 “most popular” entries. The most popular entries will be determined by assessing the number of entry “Shares” on Facebook (either from Instagram to Facebook or within Facebook) during the Entry Period.
10.19.   At the completion of Round One the 50 most popular entries will be shortlisted as finalists and proceed to Round Two.
10.20.    Round Two finalist entries will be evaluated by a panel of Judges who will evaluate the entry according to the Judging Criteria and collectively select a winner.
10.21.   The Judging Criteria for Round Two in the Social Division are:
  1. Compelling Content/Story 50%;
  2. Photographic quality 50%.
10.22.   In the event of a tie, the tied entries will be re-submitted to the Judges for a re-judging and the winner will be decided by a majority decision of the panel.
 
11.       WINNERS 
 
11.1.      The winner of each Division will be chosen on or about October 31, 2014.
11.2.      The Promoter will notify the winner of each division by email.
11.3.      The Promoter will, by email, request bank account details from each winner for the payment of the prize to the winner.
11.4.      If a notification to a winner, whether by email or regular mail, is returned to the sender as undeliverable, the Promoter may disqualify the winner and select an alternative winner.
11.5.      Winners' names will be available online at www.wpcsaved.com on or about November 19, 2014
 
12.       PRIZE DETAILS
 
12.1.      The prizes for each Division, which will be awarded to the winner of each Division, are:
Specialist Prize: One Specialist Prize will be awarded. The Specialist Prize consists of: AUD $15,000 paid by Electronic Funds Transfer to the winner’s nominated account.
Enthusiast Prize: One Enthusiast Prize will be awarded. The Enthusiast Prize consists of: AUD $3,000 paid by Electronic Funds Transfer to the winner’s nominated account.
Social Prize: One Social Prize will be awarded. The Social Prize consists of: AUD $3,000 paid by Electronic Funds Transfer to the winner’s nominated account.
Youth Prize: One Youth Prize will be awarded. The Youth Prize consists of: AUD $3,000 paid by Electronic Funds Transfer to the nominated account of the winner, or the winner’s parent or legal guardian.
12.2.      No prize transfer, assignment, or substitution by winners is permitted.
12.3.      In the event that the selected winner of any prize is ineligible, cannot be traced, do not respond within 10 days to the email described in condition 11.3, or refuses the prize, the prize will be forfeited and Promoter, in its sole discretion, may choose whether to award the prize to another entrant.

13.       GENERAL 
 
13.1.      This is a skill-based Competition, and chance plays no part in the determination of winners.

13.2           There is no limit on the number of entries per person in the Specialist and Social categories, however free entries into the Enthusiast category are limited to a maximum of five (5) per person.

13.3.      The Competition is void where prohibited under Australian Law.
13.4.      The Competition is subject to and governed by the laws of Australia and the forum for any dispute shall be based in legislation of the State of New South Wales, Australia.
13.5.      An entry will be void if the Promoter determines the photograph to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.
13.6.      The Promoter reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with the Conditions of Entry or who tampers with the entry process.  Entries submitted by disqualified entrants, whether before or after disqualification, may be removed from the website and/or Instagram. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
13.7.      If for any reason the Competition (or one or more Divisions of the Competition) is not capable of running as planned, due to technical problems or any other causes beyond the control of the Promoter, the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Competition. If Promoter elects to cancel or terminate the Competition, the Promoter will not retain any rights in the submitted photographs, and will return the fees submitted with each entry under the Specialist Division.
13.8.      Prizes will be awarded in Australian dollars. Any charges associated with conversion into any currency other than Australian dollars, and any fluctuations in any applicable exchange rate are the responsibility of the winner(s).
13.9.      All federal, state/provincial/territorial and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize-winners. The Promoter accepts no responsibility for any tax implications that may arise from winning a prize. Independent financial advice should be sought. The Promoter takes no responsibility for variations in the prize value.
13.10.   Your photo, story, profile (if provided) and username will be published on the Competition website www.wpcsaved.com and may also be used for promotional purposes outlined in Section 7 of these terms and conditions.The promoters of the Competition will also collect other personal information provided on the form such as your name and email address which will be stored securely by the Promoter and will only be used for the purpose of contacting the winners and finalists if required.  Entrants have the right to access, review, rectify or cancel any personal data held by Promoter by writing to the Office of Environment and Heritage at Level 14, 59 Goulburn Street, Sydney NSW 2000 Australia.  Please read our privacy statement at http://www.environment.nsw.gov.au/help/privacy.htm
